Anyways, I think it all really depends on the nature of the yawn. Was it a natural, instinctive yawn? Was it a fully intentional/fake yawn of disrespect? Was it a natural yawn which the defendant influenced to make more obvious than was necessary?

I think this article is far too objective to fully grasp the nature of the situation.

Even if it were an intentional yawn, 6 months is way too over the top.

Especially considering the fact that they're in Joliet, and the man is basically guaranteed sodomy if he has a cellmate.

No, the article was too objective to get into the specific mechanics of the yawn. The article was trying NOT to assert an opinion... which made the situation unclear.

I would agree with Pie that the sentence is extreme. Two or three weeks would have been sufficient.

But yawning, like breathing, is one of those bodily functions that can either be subconscious, intentional, or influenced. I mean, he could have discretely yawned whilst covering his mouth, or he could have made a scene, yawning as noticeably as possible to express his disrespect towards the judge's (likely lenient and thoughtful) sentencing.

I think those two things are very different in the context of this situation.

If you express your dream of blowing yourself up on a commercial airliner, you get your ass shot by a US flight marshal. If you express your unappreciative indifference towards a Judge's sentencing in a courtroom, you get your ass thrown in prison for six months.

Freedom of Expression has its boundaries.

No matter what type of yawn it was, they still shouldn't of sentenced him to 6 months jail. I mean come on seriously...... yawning is only a natural thing with a human being and indicates they are tired or just releasing carbon dioxide. Sometimes you can't help but yawning. What a ridiculous thing to send someone to prison for?
